TEA BAGGER TELLS STATE TO IGNORE ROE V WADE

“The federal courts don’t have the authority to make us kill babies,” according to Oklahoma Republican Party Chairman Randy Brogdon. “Are the Supreme Court justices going to come down to Oklahoma and make us stop?”

Brogdon, a former state senator who once called for Oklahoma to form its own militia separate from that National Guard — and who previously cast doubt upon the Pledge of Allegiance because he objects to the line “one nation, indivisible” — offered his interpretation of the Supreme Court’s lawful authority on Friday. One day earlier, he signed a fundraising email making a similar pitch. “As Chairman of the Oklahoma Republican Party, I call on the Governor and legislators to completely end the practice of abortion in Oklahoma,” Brogdon wrote in that email, adding that the state should “[s]hut Planned Parenthood down immediately for their illegal actions, and prosecute the abortion doctors who violate their oath to ‘do no harm.'”

The party chairman’s call to simply ignore court decisions protecting reproductive choice seeks to escalate many of his fellow Republicans’ attacks on legal abortion. Other states, however, have already gone so far in restricting abortion that it’s not clear that Brogdon’s proposal is as much of an escalation as it immediately appears to be.

Mississippi, for example, passed a law that, if upheld by the Supreme Court, will close the state’s last abortion clinic. A similar Texas law seeks to shut down many of the clinics in that state by imposing expensive obligations on clinics and difficult-to-obtain credentialing requirements on doctors who perform abortions. North Dakota enacted a law that could effectively ban abortion six weeks into pregnancy (a federal appeals court recently struck that law down, albeit reluctantly).

These laws, especially the Mississippi and Texas ones, place a premium on the cleverness of abortion’s opponents. These two states passed what amount to sham health laws — laws that appear, on the surface, to be intended to protect women’s health but which actually do little more than limit access to abortion. As one federal judge explained, “there is no rational relationship between improved patient outcomes” and the additional burden the Texas law places on abortion doctors.

Brogdon’s preferred tactic, by contrast, appears to be attacking abortion with a blunt object. He’s not looking for a clever workaround to what remains of Roe v. Wade, he just wants to outright ban abortion and prosecute doctors who perform it.

In the process, Brogdon also appears willing to openly defy court orders protecting reproductive freedom. It would be a major escalation in tactics if a state chose to openly defy the courts. It could also lead to a potentially dangerous struggle between the states and the federal government.

If Oklahoma were to “prosecute the abortion doctors,” as Brogdon suggests, the first question would be whether Oklahoma’s state courts would be willing to go along with this tactic — and whether a jury would be willing to convict based on a law that would almost certainly be struck down by federal courts. Assuming that the state courts did play along, the lawfulness of this conviction would ultimately be decided by the Supreme Court — or, barring that, by a lower federal court upon a petition for a writ of habeas corpus.

The events that would follow, if Oklahoma refused to obey a federal court order commanding them to release the incarcerated physician, could resemble a miniature Civil War. The doctor would remain physically in the state’s custody, most likely in a state prison guarded by state employees. Yet, while Brogdon is correct that the Supreme Court justices themselves wouldn’t “come down to Oklahoma and make us stop,” the federal government is fully capable of mustering superior force against a state that openly defies a court order. Just ask former Arkansas Gov. Orval Faubus.

Nevertheless, such a standoff may be acceptable to Brogdon, with his doubts that the United States is, indeed, “one nation, indivisible.

“FUCK YOUR BREATH”

Video released by an Oklahoma sheriff’s department on Friday shows an unarmed black man named Eric Harris fleeing police as they exit their cars to chase him. After officers catch up to Harris and bring him to the ground, an officer calls out the word “Taser” twice, before firing a single shot at Harris. The shot, which was fired by Reserve Deputy Robert Bates, was fatal. Harris was pronounced dead an hour later.




The shooting appears to be a tragic accident. Bates did say “Taser” before shooting Harris, and immediately after pulling the trigger, Bates drops the gun and says “Oh! I shot him. I’m sorry.” At a press conference on Friday, a Tulsa County Sheriff’s Office spokesperson claimed that Bates was a “true victim” of something called “slips and capture” — a police term for when someone does one thing while believing they are doing something else in a high stress situation. They say that Bates believed he was holding his Taser and not his firearm when he fired the round that killed Harris.

Whatever Bates’s intentions, however, the other officers on the scene respond to Harris’s cries for help by forcefully pinning him to the ground and telling him to shut up in the video released by the sheriff’s department. As Harris lies face down on the ground bleeding and crying out “oh shit man, he shot me, he shot me! Oh, he shot me!” one officer puts his knee on Harris’s head in an apparent effort to subdue him. An officer tells Harris to “shut the fuck up” shortly thereafter.

When Harris tells one of the officers “I’m losing my breath,” the officer responds, “fuck your breath.”

At the press conference on Friday, Tulsa County Sheriff’s Capt. Billy McKelvey claimed that the officers who surrounded Harris immediately after Bates fired his gun were not aware that Harris had been shot. McKelvey also claimed that they radioed for paramedics as soon as they released that Harris was wounded.

An unusual twist in this story is that Bates, the reserve deputy who shot Harris, is not a full-time officer. He is a 73-year-old insurance executive and a wealthy donor to the sheriff’s department. The department includes 130 reserve deputies who are volunteers who donate their time to law enforcement. Bates is classified as “advanced reserve,” the highest level of reserve deputy, a position that permits him to “do anything a full-time deputy can do.”

Bates did serve as a full-time police officer for one year — in 1964 and 1965 — and he had to complete 800 hours of training to be classified as advanced reserve. Once they have completed this training, however, an advanced reserve deputy must only serve for 40 hours every six months in order to maintain their certification.

At the Friday press conference, Tulsa Police Sgt. Jim Clark said the Tulsa County Sheriffs Office’s investigation concluded that Bates did not commit a crime and no policy violations occurred.

“HOMOSEXUALITY MORE DANGEROUS THAN TERRORISM”

Oklahoma is currently one of the most conservative states to have marriage equality (Alabama just got a two-week delay in holding that title). Same-sex couples are carefully beginning to exercise their new right, like Tracy Curtis and Kathryn Frazier, whose anxiety over every wedding invitation was thoughtfully profiled by the Washington Post this weekend. But conservative lawmakers have expressed their interest in circumventing that freedom to marry in several creative ways.

State Rep. Sally Kern is leading that charge. She infamously insists that homosexuality is “more dangerous” than terrorism, and has attempted to make a martyr of herself over the backlash for saying so. Last week, she filed three separate bills designed to circumvent equality for the LGBT community by either licensing discrimination or outright promoting harm.

Her first bill, HB 1597, specifically empowers businesses to refuse service to the LGBT community. Unlike the slew of bills in other states that use “religious freedom” language to create a carve-out for anti-LGBT discrimination, Kern’s bill explicitly identifies LGBT people: “No business entity shall be required to provide any services, accommodations, advantages, facilities, goods or privileges related to any lesbian, gay, bisexual or transgender person, group or association.” This bill may be the most blatant “license to discriminate” of any legislation recently proffered by conservative lawmakers across the country.

While several states are considering following the lead of California and New Jersey in banning ex-gay therapy for minors — so that the harmful, ineffective treatment cannot be forced upon them by unaccepting parents — Kern takes the opposite approach. HB 1598 would create the “Freedom to Obtain Conversion Therapy Act,” insisting, “The people of this state have the right to seek and obtain counseling or conversion therapy from a mental health provider in order to control or end any unwanted sexual attraction, and no state agency shall infringe upon that right.” This includes minors, as the bill specifically empowers parents to obtain ex-gay therapy for their children “without interference by the state.”

Lastly, Kern wants to try to prevent couples like Tracy and Kathryn from getting married even though federal courts have guaranteed them that right. Her third bill, HB 1599 (the so-called “Preservation of Sovereignty and Marriage Act”), borrows directly from similar legislation proposed in Texas to prevent government employees from receiving a salary if they issue a same-sex marriage license. “No taxpayer funds or governmental salaries shall be paid for any activity that includes the licensing or support of same-sex marriage,” the bill declares. Not only would clerks lose their salary, pension, and benefits, but any judge who issued a same-sex marriage license “shall be removed from office.”

Kern is not alone in trying to block marriage equality at the clerk level. State Rep. Todd Russ has proposed a bill (HB 1125) that would no longer allow clerks or judges to even officiate marriages anymore. If couples do not have a formal ceremony with a religious leader, they would have to file an affidavit of common law marriage instead, and they would never actually receive a marriage certificate. Russ, himself a credentialed Assemblies of God minister, told The Oklahoman that though he joins many Oklahomans in opposing same-sex marriage, “the Supreme Court stuck it down our throats,” but “marriages are not supposed to be a government thing anyway.”

It’s unclear whether lawmakers are willing to get behind these bills that clearly target the LGBT community for harm, discrimination, and unequal access to government services, nor whether they would be upheld in a federal court. Republicans do enjoy supermajorities in both the Oklahoma House and Senate, so passage cannot be ruled out.

POLICE CHIEF SHOT FOUR TIMES, SHOOTER WALKS SCOTT FREE

In Oklahoma, a white “survivalist” shot a police chief three times in the chest and once in the arm. The shooting did not result in an arrest or charges and the man, identified by local media as 29-year-old Dallas Horton, has been released.

In a press release, the Oklahoma State Bureau of Investigation said, “Facts surrounding the case lead agents to believe the man was unaware it was officers who made entry.” But Louis Ross, the Sentinel, Oklahoma police chief who was shot, said that he entered the home after “Washita County 911 received two calls from a man who identified himself as Dallas Horton, and claimed to have a bomb inside the head start school.”

Ross cast doubt on the credibility of Horton’s claim that he didn’t know officers were present, noting that there was “screaming from five officers of the law announcing our presence, requesting to see hands.” Ross only survived the shooting because he was wearing a bulletproof vest. He has “massive bruises and welts on his body” and the shot that hit his arm “went clean through.”

In a second statement released yesterday the Oklahoma State Bureau Of Investigation said Horton was “fully cooperating with the on-going investigation” and “no traces of explosives were found.”

A Facebook profile identified by Raw Story, that purports to be from a Dallas Horton of Sentinel, contains numerous racist images.

A sign on the front door of Horton’s home says he’s a “Certified zombie killer.” The mayor of Sentinel, Sam Dlugonski, described Horton as a “gun enthusiast” and survivalist. Dlugsonski was familiar with Horton, saying, “I’ve known that kid all of his life.”

So, it's ok to shoot black guys even when they're cops. Right!

Seriously readers, this has really gone beyond the level of farce a long time ago. At what point will we finally be able to call out the racists for what they are and do something about it? Because if the races were reversed, the shooter would be dead right now and the racists would insist he deserved it.

BIRTH CONTROL A POISON?

 

 

Oklahoma already prevents women from using their insurance plans to help cover abortion services, but Republicans aren’t stopping there. One state lawmaker wants to continue stripping insurance coverage for reproductive health services, advancing a measure that would allow employers to refuse to cover birth control for any reason — based solely on the fact that one of his constituents believes it “poisons women’s bodies.”

Under State Sen. Clark Jolley (R)’s measure, “no employer shall be required to provide or pay for any benefit or service related to abortion or contraception through the provision of health insurance to his or her employees.” According to the Tulsa World, Jolley’s inspiration for his bill came from one of his male constituents who is morally opposed to birth control, and wanted to find a small group insurance plan for himself and his family that didn’t include coverage for those services:

Jolley said the measure is the result of a request from a constituent, Dr. Dominic Pedulla, an Oklahoma City cardiologist who describes himself as a natural family planning medical consultant and women’s health researcher. [...]

Women are worse off with contraception because it suppresses and disables who they are, Pedulla said.

“Part of their identity is the potential to be a mother,” Pedulla said. “They are being asked to suppress and radically contradict part of their own identity, and if that wasn’t bad enough, they are being asked to poison their bodies.”

The bill has already cleared a Senate Health committee and now makes it way to Oklahoma’s full Senate. It is unlikely that either Jolley and Pedulla themselves rely on insurance coverage for hormonal contraceptive services — but if the measure becomes law, the two men could limit the health insurance options for the nearly two million women who live in Oklahoma.

Of course, contraception does not actually poison women. The FDA approved the first oral birth control pill in 1960, and that type of contraception is so safe that the American College of Obstetricians and Gynecologists recommends making it available without a prescription, as it is in most other countries around the world. Furthermore, considering that over 99 percent of women of reproductive age have used some form of birth control, the Oklahoma women who rely on insurance coverage for their contraception would likely disagree with Pedulla’s assertion that it “suppresses and radically contradicts part of their own identity.”

In reality, access to affordable birth control is a critical economic issue for women. When women have control over their reproductive choices, it allows them to achieve economic goals like completing their education, becoming financially independent, or keeping a job. But birth control can carry high out-of-pocket costs, and over half of young women say they haven’t used their contraceptive method as directed because of cost prohibitions. Nonetheless, Republican lawmakers have repeatedly pushed measures to allow employers to drop coverage for birth control.

Might I remind readers of two things; we ask that all tea baggers breed responsibly, and that the best form of birth control is looking at congressional GOPers discussing birth control!
